Terms and Conditions of Use

1. PARTIES

This agreement has been concluded between EUROPACAR OTOMOTİV GAYR. TAŞ. İNŞ. SAN. VE TİC. LTD. ŞTİ. (hereinafter referred to as "Company") and the user who creates membership through the website (hereinafter referred to as "Member").

2. SUBJECT OF THE AGREEMENT

The subject of this agreement is to determine the terms under which the Member will benefit from the car rental services offered through the www.turkeimietwagen.de website owned by the Company.

3. MEMBERSHIP CONDITIONS

  • Must be 18 years of age or older to become a member.
  • Must have a valid driver's license.
  • Information provided during membership must be accurate and up-to-date.
  • Member is responsible for account security.
  • One person can only create one membership account.

4. SERVICE SCOPE

The Company offers the following services through the platform:

  • Car rental reservation
  • Online payment transactions
  • Customer support services (24/7)
  • Vehicle delivery and return operations
  • Airport transfer services
  • Additional driver and equipment services

5. PRICING AND PAYMENT

  • Car rental fees are clearly stated during reservation.
  • Payment can be made by credit card, debit card, or bank transfer.
  • Payment on delivery option is available.
  • All prices include 20% VAT.
  • Additional services (baby seat, GPS, etc.) are charged separately.
  • In case of late return, 150% of the daily fee will be charged.

6. CANCELLATION AND REFUND CONDITIONS

  • Reservation can be cancelled free of charge up to 24 hours before the pickup date.
  • For cancellations made less than 24 hours in advance, a 1-day fee will be charged.
  • Refund transactions are completed within 7-14 business days.
  • In case of early return, no refund will be made for remaining days.
  • Full refund will be made in case of cancellation due to weather conditions or force majeure.

7. RESPONSIBILITIES

7.1. Company's Responsibilities

  • Delivery of vehicles in clean, maintained, and working condition
  • Provision of full coverage insurance
  • 24/7 customer support
  • Emergency roadside assistance service
  • Vehicle replacement (in case of breakdown)

7.2. Member's Responsibilities

  • Use the vehicle carefully and maintain it
  • Comply with traffic rules
  • Return the vehicle on time
  • Report immediately in case of damage
  • Be responsible for traffic fines
  • Not transfer the vehicle to third parties
  • No smoking (€100 cleaning fee if smoking)

8. PRIVACY AND PERSONAL DATA

Member's personal data is protected under the Personal Data Protection Law No. 6698 (GDPR) and is not shared with third parties. For detailed information, please review our GDPR Information Text and Privacy Policy.

9. PROHIBITIONS

Member cannot perform the following actions:

  • Use the vehicle in illegal activities
  • Use the vehicle in races or test drives
  • Use the vehicle under the influence of alcohol or drugs
  • Take the vehicle abroad without permission
  • Use the vehicle for commercial purposes (taxi, cargo, etc.)
  • Roll back or alter the odometer

10. TERMINATION OF THE AGREEMENT

Parties may terminate the agreement by giving 15 days' written notice. The Company has the right to terminate immediately if the Member violates the terms of the agreement.

Termination Reasons:

  • Failure to fulfill payment obligations
  • Providing false or fraudulent information
  • Violation of agreement terms
  • Damage or loss of the vehicle

11. FORCE MAJEURE

No liability arises if parties cannot fulfill their obligations due to force majeure such as natural disasters, war, terrorism, epidemics, strikes.

12. DISPUTE RESOLUTION

Adana Courts and Enforcement Offices are authorized for disputes arising from this agreement. Parties commit to seeking resolution through mediation first.

13. AMENDMENTS

The Company has the right to amend these agreement terms by giving prior notice. Amendments are effective from the date they are published on the website.

14. EFFECTIVENESS

This agreement becomes effective upon Member's approval and remains valid unless terminated by either party.
